TERMS AND CONDITIONS

  1. This Regulations define the general conditions, rules, and method of sale conducted by Ewa Kociuba, conducting business under the name Ewa Kociuba Ceruleum, address: Osiedle Kolorowe 7/30, 31-938 Krakow, Tax ID: 687-182-43-74, REGON: 123068379, through the website https://pracowniatemper.pl, (hereinafter referred to as the “Service Provider”).
  2. All rights to the Website, including proprietary copyrights, intellectual property rights to its name, its domain, the Internet Page, as well as patterns, forms, logos posted on the Internet Page (excluding logos and photos presented on the Website for the purpose of presenting goods, to which copyright belongs to third parties) belong to the Service Provider, and their use can only take place in a manner specified and in accordance with the Regulations.
  3. The information contained on the Website does not constitute an offer by the Seller, within the meaning of the Civil Code, but only an invitation to Customers to submit offers to conclude a sales contract for Goods.
  4. The condition for concluding a contract is sending an offer to purchase goods by the Ordering Party and its acceptance by the Service Provider using the form on the website, email, or phone.
  5. A necessary condition for order fulfillment is to provide a telephone number and email address. After the order is accepted, the Ordering Party will be informed of its acceptance by phone or email. Orders that cannot be confirmed within 48 hours will not be fulfilled.
  6. Orders can be placed 24 hours a day, year-round. Orders placed on weekdays, Saturdays, Sundays, and holidays will be processed on working days from 8:00 to 15:00.
  7. In the event of circumstances that completely or temporarily prevent the execution of the placed order, the Service Provider reserves the right to suspend the order’s fulfillment.
  8. Confirmed orders cannot be canceled.
  9. Incorrectly completed order forms will not be considered.
  10. In the case of selling goods to Consumers, the Consumer has the right to withdraw from the contract within 10 days from the date of delivery of the item.
  11. For “Made to Order” items, returns are not accepted.
  12. The Client is obliged to pay the price upon personal receipt of the goods or in advance to the Service Provider’s bank account. Account number: 69 1140 2004 0000 3502 7573 5053.
  13. For “Made to Order” items, the Client is required to make an advance payment of 30% of the price. Payment of the remaining amount takes place after the Service Provider sends a photograph of the final result. Shipping is free only within Poland.
  14. The price is binding for both parties at the time of placing the order. The product price does not include shipping costs.
  15. The Service Provider reserves the right to reject the purchase offer without giving reasons.
  16. By accepting the regulations, the Ordering Party agrees to receive commercial information and the processing of personal data in accordance with the Personal Data Protection Act.

PRIVACY POLICY

In accordance with Article 13 paragraphs 1-2 of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, GDPR) – I inform you that: The Administrator of Your Personal Data is: Ewa Kociuba Ceruleum, Osiedle Kolorowe 7/30, 31-938 Krakow

Legal basis of processing: As a Data Administrator, we will process your data on the basis of the following legal grounds and for the following purposes:

 

  • to perform the subject of the contract on the basis of the given consent – legal basis: Article 6(1)(a) of the GDPR;
  • to perform the service and ensure the proper quality of services in connection with the conducted business activity on the basis of the Administrator’s legitimate interest – legal basis resulting from Article 6(1)(f) of the GDPR;
  • to perform the subject of the contract, the party of which is the person whose data is concerned – legal basis: Article 6(1)(b) of the GDPR;
  • to fulfill the legal obligations incumbent on the Administrator, e.g., issuing and storing accounting documents, responding to complaints within the time and form provided for by generally applicable law, archiving documents for the period required by law – legal basis resulting from Article 6(1)(c) of the GDPR;
  • to determine or pursue possible claims or defense against such claims, being the realization of our legitimate interest in connection with the conducted business activity – legal basis: Article 6(1)(f) of the GDPR;
  • for the purpose of promoting our own services and direct marketing, including funpages on social media platforms (e.g., Facebook, Instagram, etc.), as a legitimate interest of the Administrator – legal basis: Article 6(1)(f) of the GDPR;

Rights of data subjects: According to the GDPR, you have the following rights: the right of access to your personal data and to obtain a copy of your personal data being processed; the right to rectify your incorrect data; the right to request the erasure of data (the right to be forgotten) in the event of circumstances provided for in Article 17 of the GDPR; the right to request the restriction of data processing in cases indicated in Article 18 of the GDPR; the right to object to the processing of data in cases indicated in Article 21 of the GDPR; the right to data portability, provided data was provided in an automated manner.

Data recipients: 1. Your personal data will be provided to other recipients, to whom data processing has been entrusted, i.e., processing entities (processors) on the basis of written data processing entrustment agreements granted by the Administrator, e.g., accounting firms, law firms, IT companies, postal services, financial institutions, state bodies and institutions, as well as law enforcement and judicial authorities, which is necessary to fulfill the subject of the contract. 2. Your data will not be transferred to third countries or international organizations. 3. Your data will not be processed in an automated manner, including profiling.

This Regulation shall apply from August 1, 2022 and may change in the future.
